Personal information protection policy

Please read our Personal Information Protection Policy (the “Policy”).

The Policy aims to protect personal information by Madli inc., doing business under the name Mobile-Punch (hereinafter “the company” or “we”).

The company is committed to protecting the privacy of its customers, employees and representatives. This is one of the main foundations of our business. It also undertakes to ensure the confidentiality of personal information (also hereinafter “data”) entrusted within the framework of its professional activities.

This Policy aims to comply with current Canadian laws relating to the protection of personal information and applicable regulations to ensure optimal protection of data processed within our company. Since the collection of personal information about you allows us to offer you high quality service, we have implemented rigorous security measures to ensure that your data remains strictly confidential.

1. Personal information
In the context of this Policy, personal information refers to any information concerning an individual allowing them to be identified, whether postal contact details, a telephone number, a social insurance number, a family situation or even one or more elements specific to physical, psychological, economic, cultural or social identity.
Regardless of the nature, medium or form of personal information, it remains protected.

2. Using the Mobile-Punch application
The use of the Mobile-Punch application is subject to compliance with the service contract which binds the customer to the company and to this Policy. If you access and use our application, you agree to be bound by the terms and conditions contained in these documents. If you do not agree to be bound by these terms and conditions, please do not access or use our application.

3. Consent
A) We ask that your consent to the collection, use and communication of your data is free and informed. Depending on the nature of the consent required, you may give it orally, in writing or electronically. You must understand the consequences of collecting, using and disclosing your personal information before proceeding.

B) The company ensures that all users of the Mobile-Punch application are of the minimum age required to give valid consent according to the laws in force for the purposes of the collection of their personal information.

C) Generally, the company will ask for your consent when collecting, using or disclosing your personal data unless otherwise required or authorized by law.

D) You may withdraw your consent at any time, subject to certain legal or contractual restrictions, by providing reasonable notice. If you choose to withdraw your consent, your decision will be recorded in our records and Mobile-Punch may not be able to provide you with quality customer service.

E) When you use the Mobile-Punch application, you agree that your personal information transmitted will be used in accordance with this Policy and that some of this information will be accessible to your employer via the application.

4. Collection of your personal information
A) We only collect the personal information we need to serve you well.

B) When you register on our application, you must provide certain personal information, including your name, telephone number.

C) The company may ask you for certain personal contact details or other information in order to provide you with optimal service with the application.

D) Your data provided on the application is shared with your employer and the company only.

E)No data will be taken without your consent

F) The personal data of users is limited to staff members of the company for which you are employed whose functions make this access necessary and who have an administrator role in the dashboard.

5. Advanced Features
A) The Punch function of the application. A geolocation function is also activated to ensure that the person is indeed at the workplace or any other location determined by the employer. Once the punch is done, the geolocation turns off by itself.

B) When the employer decides to use the Photo Punch feature of the application, a photo of the worker’s face is taken and saved in the application to validate their identity.
C) When the employer uses the Geolocation function, the geographic location of the worker is transmitted and recorded in the application at the time the employee performs the punch in / punch out action only. Subsequently, geolocation is automatically inactive.

6. Use of your personal information
Access to your personal information is given only to persons authorized to receive it within the company when this information is necessary to carry out their duties. Here are the situations in which the company may use your personal information:

A) The transactions required on the application;

B) The information required on the application and necessary for its proper functioning (timesheets, work schedule, time capture by fixed and mobile time clocks as well as all other information relating to the management of the person’s presence at work) . The employer will have access to this information through the application;

C) Your employer will have access to your geographic location when you clock in and out of work so that it can validate whether you are at the workplace at the agreed times;

E) If necessary to fully understand and identify your preferences in order to offer you a personalized service;

F) The company will be able to access the accounts of one or more users to observe their interactions in the application, to correct data, to import a list of employees or resources, to create schedules, to write messages, comments or notes. All these actions are carried out in order to offer you a most personalized application;

G) The company may send you a notice by email, SMS or Facebook, even after you cease to be a user of the application, to inform you of our promotions, our features and our products . Please note that you can withdraw your consent on this subject at any time by following the procedure detailed under Withdrawal of consent.
All of your personal information will not be used for purposes other than those listed above, unless the company has obtained consent from you in this regard or if the law requires or authorizes it.

 

7. Communication of your personal information
A) Mobile-Punch customers use the application for calculating working hours with punch mobile, geolocation of the worker, management of working hours and project management. A Mobile-Punch customer therefore has access to the personal information of all authorized users who use the application. Each Mobile-Punch customer retains the responsibility, as an employer or principal, to ensure respect for the confidentiality and private life of users of the application and to apply any law or regulation if there is place.
B) Subject to the conditions described in the Policy, the communication of your personal information to third parties requires your consent. When authorized or required by law, however, we may communicate your personal information without your consent while ensuring that we only disclose the information required.
C) When we need to transmit your personal information to a third party that operates in a foreign jurisdiction, please be aware that local law may generally allow third parties to have access to your personal information without your consent.

8. Sensitive Information
Generally, Mobile-Punch does not collect sensitive information such as medical, personal financial data, social security numbers or records relating to criminal or penal convictions.

9. Retention of your personal information
A) We retain your personal information for as long as necessary for the purposes for which it was collected.

B) Our customer contracts provide that they are kept for five years, after which they are destroyed, unless there is an agreement to extend the period in order to meet its obligations.

C) Mobile-Punch must destroy personal information in accordance with the law and the internal records retention policy. When we destroy your personal information, we take the necessary measures to ensure its confidentiality and we ensure that no unauthorized person can access it during the destruction process.

As far as we are concerned, the data is encrypted and stored on Google Cloud cloud servers based in Canada (Quebec) with the highest certifications in the industry.

10. Withdrawal of consent
A) You may withdraw your consent at any time, subject to certain legal or contractual restrictions. We will notify you of the consequences of any withdrawal, including the possibility that a product cannot be supplied or a request cannot be fulfilled.

B) You may withdraw your consent to email, SMS and Facebook notifications at any time by changing the communication settings in your account.

11. Questions and surveys
A) When you use the application, you agree that Mobile-Punch may contact you to carry out surveys to collect personal information provided voluntarily. Under no circumstances will you be required to participate in such surveys or polls or provide the personal information requested.

B) If you agree to respond to Mobile-Punch surveys, please be aware that the company will use the personal information obtained simply to provide a general overview of the profile of its users. Mobile-Punch may then contact you to collect your comments or suggestions regarding the application or its services offered.

C) Your consent can be withdrawn at any time if you wish. Simply send a notice by email to info@mobilepunch.com, and specify “Withdrawal of consent” in the subject line of the email.
